ABOUT US

The Directorate BBBEE Charters Compliance seeks to facilitate Broad–Based Black Economic Empowerment (BBBEE) in the Agricultural Sector; Forest Sector and the Fisheries Sector by facilitating the development and implementation of the Sector Codes or Transformation Frameworks in partnership with all the major Stakeholders in all the three sectors by:

  • Promoting equitable access and participation of Black people in the entire agricultural value chain;
  • De-racialising land and enterprise ownership, control, skilled occupations and management of existing and new agricultural enterprise;
  • Unlocking the full entrepreneurial skills and potential of Black people in the sector;
  • Facilitating structural changes in agricultural support systems and development initiatives to assist Black South African in owning, establishing, participating in and running agricultural enterprises;
  • Socially uplifting and restoring the dignity of Black South Africans within the sector;
  • Increasing the extend to which communities, workers, co-operatives and other collective enterprises own and manage existing and new agricultural enterprises, increasing their access to economic activities, infrastructure and skills training.
  • Increasing the extend to which Black women, people living with disabilities and  youth own and manage existing and new enterprises, increasing their access to economic activities, infrastructure and skills training;
  • Empowering rural and local communities to have access to agricultural infrastructure, ownership and skills.

 

The implementation of the BBBEE in the agriculture, forestry and fisheries sectors is guided by the empowerment indicators as outlined in the Generic Codes of Good Practice as follows:

  • Ownership (Land and Equity Ownership)
  • Management control
  • Employment equity
  • Skills development
  • Preferential procurement
  • Enterprise Development and
  • Socio-Economic Development

 

The agricultural enterprises are measured in terms of AgriBEE Sector Code, which was published on the 28th December 2012 in terms of Section 9 (1) of the B-BBEE Act 53 of 2003. The forest enterprises are measured in terms of Forest Sector Code, which was published on the 12th June 2009 in terms of Section 9 (1) of the B-BBEE Act 53 of 2003. The fisheries enterprises are measured in terms of B-BBEE Generic Codes of Good Practice.

JOB PURPOSE OF THE DIRECTORATE:

To develop and ensure compliance to the BBBEE charters.

FUNCTIONS OF THE DIRECTORATE:

  • Formulate BBBEE policy, guidelines, and legal framework and management measures within the sector.
  • Set norms, standards and minimum service delivery standards.
  • Support the co-ordination by DAFF of BBBEE implementation and sustainability in the sectoral councils.
  • Establish and maintain data base on BBBEE status and needs.
  • Develop policies, norms and standards for the allocation of permits in line with the DAFF sector charters (AgriBEE, Forestry and Fisheries Sector Charter).

 

OBJECTIVES OF THE DIRECTORATE:

  • Provide strategic leadership with regards to Broad Based Black Economic Empowerment within the three sectors (Agriculture; Forestry and Fisheries) through:

 

    • Formulation of BBBEE policy, guidelines, frameworks and management measures for the sectors.
    • Development of BBBEE scorecard for the sectors.
    • Development and maintenance of BBBEE status and needs database.
    • Development of policies, norms and standards for the allocation of permits in line with the DAFF sector charters (AgriBEE, Forestry Sector Charter).
    • Development of norms and standards for the sustainability of BBBEE businesses within the sector.
    • Development of frameworks for monitoring and evaluating the implementation of BBBEE within the Department.
    • Provision of strategic advice to the DAFF management and units within the Department with regards to the implementation of BBBEE within the Department.
  • Sustaining of BBBEE businesses within the sectors through:

 

    • Conducting audits of BBBEE businesses to determine level of support required to achieve sustainability standards as developed.
    • Managing the provision of support to BBBEE businesses within the sector.
    • Developing and formalising partnerships to ensure that appropriate support is given to BBBEE businesses.
    • Managing the roll out of relevant skills development programme.
  • Oversee and provide support to the Charter Councils by:

 

    • Preparing and submitting reports on Charter Council meetings.
    • Consolidating Charter Councils’ reports into the Departmental annual report.
    • Monitoring the activities of the Charter Councils.
    • Providing secretariat support to the Charter Councils.
  • Provide status reports on BBBEE compliance in the sectors by:

 

    • Preparing and providing status reports on BBBEE compliance in the sector.
    • Collating sector reports from the various verification agencies on compliance to the Sector Codes.
    • Liaising with the other government Departments on non compliance to the Sector Codes.
    • Collating sector information from businesses on the implementation challenges of the Sector Codes.
    • Implementing recommendations to address challenges of business arising from Sector Codes.
